Terms and Conditions

Qondatec reserves the right, at its sole discretion, to change, modify or remove all or part of these CU at any time. It is your responsibility to constantly check and consult these CU in order to be aware of such changes or modifications. Your continued use of our products and services by accessing our Website means that you agree to the CU modified or added at that time. As long as you comply with these CU, Qondatec grants you the exclusive, non-transferable and limited use of the Website.

Through its Website, www.qondatec.com, Qondatec provides information about its Products and Services and offers its Users and/or Customers the possibility of contracting and/or acquiring them. Due to the content and purpose of the Website, people who wish to benefit from its services must have the status of "Customer", which they acquire by filling out the registration form and following the steps that Qondatec will subsequently communicate to them by email for such purposes. The status of Customer implies adherence by them to the CU in the version published at the time they access the Website.

In any case, there are pages of the Website accessible for consultation by individuals or legal entities who do not register or initiate a product purchase (hereinafter, "Users"). In this sense, Users who access these parts of the Website agree to be subject to the terms and conditions set forth in these CU, to the extent that they may be applicable to them.

When a Customer logs in, Qondatec uses cookies so that they do not have to enter their data every time. These cookies are reset each time the Customer accesses the Website and last approximately one month. In this way, the Customer's session remains open for approximately 30 days. Even so, and as a security measure, if the Customer tries to access private sections, such as "My account", 30 minutes after the Customer has logged in, Qondatec will ask them to identify themselves in order to access said sections. If the Customer does not wish for their session to remain open, they can close it from the "Log out" link in the upper right corner of the Website, at any time and each time they enter the Website.

I. Product information

The descriptions of the Products displayed on the Website are based on information provided directly by Qondatec's suppliers. However, the information given about each Product, as well as the photographs or videos related to them and the commercial names, brands or distinctive signs of any kind contained on the Qondatec Website, are displayed on www.qondatec.com as a guide and with the consent of their owners.

Some Products and/or Services, due to their nature, may be subject, in addition to these CU, to particular conditions of sale. These particular conditions of sale will always be accessible to the Customer in a link in the Product and/or Service itself along with its description. It is essential that all Users verify the particular conditions of each Product and/or Service before making their purchase, in order to ascertain the terms, conditions and restrictions that may apply particularly.

In this sense, the Customer, prior to the purchase of the Product, must accept the particular conditions (including, without limitation, compliance with any terms and conditions, rates and reservations established). The provisions contained in these CU may be added, limited or modified depending on the corresponding particular conditions of sale of the Product in question. In case of conflict or contradiction between the CU and the particular conditions of sale, the particular conditions will prevail over these CU. Consequently, the Customer must carefully read, in addition to the Terms of Use, the particular conditions of sale, which will be understood as accepted at the time the Customer proceeds to purchase the Product and/or Service.

II. Availability

Qondatec informs the Customer that the number of units available for sale were reserved by our suppliers for sale on the Qondatec Website. Under no circumstances will Qondatec intentionally offer for sale more units than the supplier has reserved.

Qondatec will do everything possible to satisfy all its Customers' demand for the Products. However, sometimes, and due to causes that are difficult for Qondatec to control, such as human errors or incidents in computer systems, it is possible that the quantity finally served by the supplier differs from the order placed by Qondatec to satisfy Customer orders.

In the event that the Product is not available after the order has been placed, the Customer will be informed by email about the total or partial cancellation of their order. Partial cancellation of the order due to lack of availability does not entitle to the cancellation of the entire order. If, as a result of this cancellation, the Customer wishes to return the delivered Product, they must refer to, and follow the steps indicated in the Return section of these CU.

III. Payment

The Customer is obliged to pay the total price of the Products they purchase at the same time the order in question is placed, in case they do not have credit terms. The initial price appearing on the Website for each of the Products offered will be added the corresponding amounts for shipping costs that may be generated. In any case, said amounts or rates will be communicated to the Customer in advance, before formalizing the purchase.

The ticket or proof of purchase corresponding to the purchase order will be available to the Customer and can be viewed on the www.qondatec.com Website in the "My Account"; "Orders" section.

The Customer must make the payment by credit card (Visa or Mastercard or Amex) or using PayPal payment systems.

III. Security

Qondatec has the highest commercially available security measures in the sector. In addition, the payment process works on a secure server using the SSL (Secure Socket Layer) protocol. The secure server establishes a connection so that the information is transmitted encrypted using 128-bit algorithms, which ensure that it is only intelligible to the Customer's computer and the Website's. In this way, by using the SSL protocol, it is guaranteed, as far as possible:
1. That the Customer is communicating their data to the Qondatec server center and not to any other that tries to impersonate it.
2. That between the Customer and the Qondatec server center, data is transmitted encrypted, preventing its possible reading or manipulation by third parties.

Likewise, Qondatec states that it does not have access to or store sensitive data related to the payment method used by the Customer. Only the corresponding payment processing entity has access to this data for payment and collection management purposes. This entity is completely unrelated to Qondatec, so Qondatec cannot be held responsible for the use it makes of said data. Once the purchase process is completed, an electronic document is generated in which the contract is formalized and which the Customer can print.

For its part, Qondatec, ensuring the security of its Customers and the transactions they make through the Qondatec Website, informs its Customers that it has implemented a program for the detection of possible fraudulent operations, for which reason Qondatec reserves the right to request additional information, confirmations and/or documents from Customers, even after having made one or more purchases through the Website, by telephone call or email addressed to the number or account provided by the Customer, in order to confirm that the Customer has indeed made and authorized said purchase(s) and thereby definitively authorize the respective transaction(s), among which, by way of example, but not limitation, Qondatec may make various telephone checks on the Customer's identity, or request: (a) a written confirmation and authorization signed by the Customer responsible for the respective purchase(s); and (b) a copy of the Customer's current official identification with a photograph to confirm their identity. Qondatec undertakes to safeguard such information and documents with the highest security measures at its disposal, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties in force.

In the event that the Customer does not respond favorably or does not deliver to Qondatec the requested documentation and information within a period of 48 hours counted from the call or the sending of the email, the transaction(s) detailed in said communication and the respective order(s) may be canceled automatically, without prior notice or liability for Qondatec for Customer security, and Qondatec will proceed with the automatic reimbursement of the amount(s) paid by the Customer regarding said purchase(s).

This procedure is for the security of Qondatec's Customers and therefore, the Customer, by accepting these Terms of Use, agrees to be subject to the aforementioned procedure for detecting possible fraudulent operations, without liability for Qondatec and likewise authorizes Qondatec to use the information and additional documents provided by the Customer for future transactions made by the same Customer.

IV. Order formalization

Once the order has been formalized, that is, with the acceptance of the CU and the particular conditions of sale, if applicable, upon confirmation of the purchase process, Qondatec will always send an email to the Customer confirming the details of the purchase made.

V. Order cancellation

Qondatec will accept order cancellations when requested before the start of their processing in its warehouse and/or their shipment with the designated courier service. Order cancellations will not be accepted for operational reasons since your order is already in preparation; in these cases, you must wait to receive it to proceed with its return if you wish. If the Customer and/or User still wishes to cancel an order once the current sale has ended, they must proceed with its return.

To make the cancellation, the Customer must send an email to ayuda@qondatec.com requesting the partial or total cancellation of their order.
Qondatec reserves the right to cancel orders in the cases and according to the terms and conditions indicated in the “Security” section of these CU, without liability for Qondatec.

VI. Warranty of purchased products

Qondatec acts as a distributor for manufacturers or wholesale distributors who guarantee that the Products marketed by Qondatec de CV function correctly and do not present defects or hidden flaws that could make them dangerous or unsuitable for normal use. Notwithstanding the foregoing, the use that each Customer and/or User makes of the Products is their sole responsibility, without any liability on the part of Qondatec.

The contractual warranty offered is the one usually granted by the supplier. The duration of such warranties is issued and endorsed by the manufacturer or supplier of each Product, so Qondatec assumes no responsibility for such warranties and the Customer and/or User undertakes to contact the supplier or manufacturer of the Product in question directly to enforce such warranty.

Once the Customer and/or User has received the Product, they will have a brand information brochure, sufficient instructions for the correct use and installation of the Product and all information about the warranty that its manufacturer may have granted. No Customer and/or User may request a broader warranty from Qondatec than that indicated therein.

In such cases, Qondatec will not be obliged to respond for such warranties, nor to collect the damaged Product(s), so the Customer and/or User must contact and address directly the after-sales service of the supplier or manufacturer of the Product in question. In this sense, Qondatec will take actions aimed at providing Customers and/or Users who request it with the contact details of said service and will provide them with sufficient information for the submission of relevant claims.

The warranty will lose its validity in case of defects or deterioration caused by external factors, accidents, especially electrical accidents, wear and tear, installation and use not in accordance with the instructions of the supplier or manufacturer.

Products modified or repaired by the Customer and/or User or any other person not authorized by the supplier or manufacturer are excluded from the warranty. The warranty will not apply to apparent defects and conformity defects of the Product. The warranty will not cover Products damaged by improper use.

All our products have a direct manufacturer's warranty, which comes into effect from the date of purchase shown on the receipt you receive when you pay for your order. If the purchased product has any defect or failure, the customer must contact the manufacturer directly to validate their warranty. Below you will find the contact details of each company, where they can inform you about a remote solution, product shipping address for warranty validity or about a service center near your location.

In the event that the manufacturer does not have a service center in the country or is not receiving the deserved attention, you can send us an email to ayuda@qondatech.com with your order number, purchase date, model and serial number. You will then be answered with steps to follow.

VII. Intellectual and industrial property

Qondatec and its licensors and licensees hold, either by themselves or by virtue of a contract with third parties, all rights over the content, design and source code of the Website and, in particular, by way of example, but not limitation, over the photographs, images, texts, logos, designs, trademarks, trade names and data included therein.

Customers and Users are warned that such rights are protected by current international legislation relating to intellectual and industrial property or copyright.

Likewise, and without prejudice to the foregoing, the content of this Website is also considered a computer program, and, therefore, all current international regulations on the matter are also applicable to it.

The total or partial reproduction of this Website, even by means of a hyperlink, or of any of its contents, is expressly prohibited without the prior express written permission of Qondatec.

Likewise, the copying, reproduction, adaptation, modification, distribution, commercialization, public communication and/or any other action that implies an infringement of current international legislation on intellectual and/or industrial property, as well as the use of the contents of the Website without the prior express written authorization of Qondatec, is totally prohibited.

Qondatec informs that the mere act of accessing and consulting the Website does not grant any implicit license, authorization or right over the intellectual and/or industrial property rights or over any other related right or property, directly or indirectly, with the contents included in the Website.

VIII. Access and permanence on the website and our contents

Customers and Users are entirely responsible for their conduct when accessing the information on the Website, while browsing it, as well as after having accessed it.

As a consequence of the foregoing, Customers and Users are solely responsible to Qondatec and to third parties for:
a) the consequences that may arise from a use, for illicit purposes or effects or contrary to these CU, of any content on the Website, whether or not prepared by Qondatec, published or not under its name officially;
b) as well as the consequences that may arise from the use contrary to the content of these CU and harmful to the interests or rights of third parties, or that in any way may damage, disable or deteriorate the Website, the reputation of Qondatec and/or the Products and services it offers on the Website or its services, or prevent the normal enjoyment by other Customers and/or Users.

Qondatec reserves the right to update the contents when it deems it appropriate, as well as to eliminate them, limit them or prevent access to them, temporarily or permanently, as well as to deny access to the Website to Customers and Users who misuse the contents and/or fail to comply with any of the CU that appear in this document.

Qondatec informs that it does not guarantee:
a) That access to the Website and/or linked pages will be uninterrupted or error-free;
b) That the content or software that Customers and Users access through the internet or the Website of the linked pages does not contain any errors, computer viruses or other elements in the content that may cause alterations in their system or in the electronic documents and files stored in their computer system or cause other types of damage;
c) The use that Customers and Users may make of the information or content of this Website or linked pages for their personal purposes.

The information contained in this Website should be considered by Customers and Users as informative and guiding, both with regard to its purpose and its effects, which is why:

Qondatec does not guarantee the accuracy of the information contained in this Website and therefore assumes no responsibility for any possible damages or inconveniences for Customers and Users that may arise from any inaccuracy present on the Website.

IX.Our Responsibility

Qondatec assumes no liability for any reason, including but not limited to:
a) The use that Clients or Users may make of the materials on this Website or linked pages, whether prohibited or permitted, in infringement of the intellectual and/or industrial property rights of the Website's content or third parties.
b) Any damages to Clients or Users caused by normal or abnormal operation of search tools, the organization or location of content and/or access to the Website, and, in general, errors or problems generated in the development or implementation of the technical elements that the Website or a program provides to the User.
c) The content of those pages that Clients or Users may access from links included on the Website, whether authorized or not.
d) The acts or omissions of third parties, regardless of whether these third parties may be linked to Qondatec through a contractual agreement.
e) The access of minors to the content included on the Website, being the responsibility of their parents or guardians to exercise adequate control over the activity of the children or minors under their care or to install any of the Internet use control tools in order to prevent (i) access to materials or content not suitable for minors, as well as (ii) the sending of personal data without the prior authorization of their parents or guardians.
f) Communications or dialogues during debates, forums, chats, and virtual communities organized through or around the Website and/or linked pages, nor will it be responsible, therefore, for any damages suffered by individual and/or collective Clients or Users as a result of such communications and/or dialogues.

Qondatec will not be liable in any case when:
a) Errors or delays in accessing the Website by the Client when entering their data in the order form, the slowness or impossibility of receiving confirmation of the order by the recipients, or any anomaly that may arise when these incidents are due to problems in the Internet network, fortuitous events or force majeure, and any other unforeseen contingency beyond the good faith of Qondatec.
b) Failures or incidents that may occur in communications, deletion, or incomplete transmissions, so that the Website's services are not guaranteed to be constantly operative.
c) Errors or damages caused to the Website by inefficient and bad faith use of the service by the Client.
d) The non-operation or problems in the email address provided by the Client and/or User for sending the order confirmation.
e) In any case, Qondatec undertakes to solve any problems that may arise and to offer all necessary support to the Client and/or User to reach a quick and satisfactory solution to the incident.
f) Likewise, Qondatec has the right to carry out promotional campaigns for defined time intervals to promote the registration of new members in its service. Qondatec reserves the right to modify the conditions of application of the promotions, extend them with due notice, or proceed to the exclusion of any of the participants in the promotion in the event of detecting any anomaly, abuse, or unethical behavior in their participation.

X. Nullity

In the event that any clause of these CU is declared null, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these CU.

Qondatec may not exercise some of the rights and powers conferred in this document, which will not imply in any case the waiver of them, unless expressly recognized by Qondatec or prescription of the action that corresponds in each case.

XI. Modification of the terms of use

Qondatec reserves the right to modify, at any time, the presentation and configuration of the Website, as well as these CU or General Conditions. Therefore, Qondatec recommends that the Client and/or User read them carefully each time they access the Website. Clients and Users will always have these CU in a visible place, freely accessible for any queries they wish to make. In any case, the acceptance of the CU, in force at any given time, will be a prior and indispensable step to the acquisition of any Product available through the Website.

XII. Information request

Qondatec may ask you for additional information to validate your identity and comply with the corresponding laws or reforms regarding commercial transactions.

We may contact you by email and/or phone call to inform you that we do not have all the required information or documentation related to your account or transaction made on our website.

In case of doubts with your account or order placed through our portal, we will request the following documentation:

1. Copy of official identification (passport, INE or professional license) of the cardholder.
2. Proof of address no older than 3 months for the delivery address.
3. Proof of your purchase.

After you send us this information, you will receive a confirmation that we received your documentation.
